Restaurant refused to plate up leftovers for health and safety reasons

A restaurant refused to plate up left overs for a customer to take away. They said they were unable to due to health and safety reasons.
There is no Health and Safety at Work or Food Hygiene legislation that prohibits customers taking away leftovers. However, in some cases it could be inadvisable to do so on food safety grounds, but this was not made clear by the waitress' comments. Management at the restaurant have agreed they will ensure that their staff are clear about the reasons for their decisions to avoid misleading excuses being used.
